1. Acceptance of Terms

By accessing and using shortshero ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

shortshero is an AI-powered video repurposing platform that automatically detects the most engaging moments in your long-form videos and transforms them into viral short-form clips for TikTok, Instagram Reels, and YouTube Shorts — complete with animated captions, virality scores, and one-click export.

2. Description of Service

shortshero provides the following services:

• AI-powered clip detection from long-form videos (podcasts, interviews, YouTube videos, webinars)
• Automatic transcription and word-by-word animated captions
• AI virality scoring for each detected clip
• Caption style customization (font, color, animation)
• Face-tracking auto-reframe for portrait/vertical formats
• Video editor with timeline, captions, and trim controls
• One-click MP4 export ready for TikTok, Instagram Reels, and YouTube Shorts
• Social media publishing via connected platforms

3. Pricing and Billing

Credit-Based System

shortshero operates on a credit-based system. Credits are consumed when you upload and process videos. Credit costs vary by video length and features used — for example, AI analysis, transcription, face-tracking, and rendering each draw from your credit balance.

Credit Packs

You can purchase credit packs at any time. All payments are processed securely via our payment processor. Prices are subject to change with 30 days notice.

• Credits do not expire and remain in your account until used
• No recurring subscriptions unless you choose a subscription plan
• Pay only when you need more credits

3a. Abandoned Cart Recovery

When you enter your email address and begin the checkout process for any shortshero product, you acknowledge and agree that:

• If you do not complete your purchase, shortshero may send you one or more automated recovery emails via our payment processor (Creem) to invite you to return and complete your order
• Recovery emails are sent after approximately 24 hours of checkout inactivity
• You may opt out of recovery emails at any time using the unsubscribe link included in each email, or by contacting us at contact@shortshero.com
• Transactions completed through a recovery email link are subject to a 5% fee charged by Creem — this does not affect the price you pay; it applies to recovered revenue on our side

4. User Responsibilities

As a user of shortshero, you agree to:

• Provide accurate information when creating your account
• Use the service for lawful purposes only
• Only upload videos and content you have the legal right to use and repurpose
• Not attempt to reverse-engineer or copy our AI clip detection pipeline
• Not use the service to generate harmful, illegal, or infringing content
• Respect rate limits and fair-use guidelines
• Not impersonate others or create deepfakes without consent
• Comply with all applicable platform guidelines (YouTube, TikTok, Instagram) and laws

5. Content and Intellectual Property

Your Content

You retain full ownership of all videos you upload and all clips generated from them. shortshero does not claim any ownership over your content.

Content Responsibility

You are solely responsible for:

• Ensuring you have the right to upload and repurpose any video you submit
• Reviewing all generated clips for appropriateness before publishing
• Complying with copyright laws (music, footage, third-party material in your videos)
• Meeting any disclosure requirements for AI-assisted content on publishing platforms

Platform Rights

shortshero and its original content, features, and AI models are owned by us and protected by international copyright and intellectual property laws.

6. Privacy and Data Protection

We take your privacy seriously. Our data practices include:

• Uploaded videos are stored securely on AWS S3 and tied to your account
• Generated clips and transcriptions are saved to your dashboard for convenience
• We use your data only to provide and improve our services
• We do not sell or share your personal information with third parties
• You can request deletion of your data at any time

7. Service Availability and Limitations

While we strive for high availability, shortshero is provided "as is" and we cannot guarantee:

• Continuous, uninterrupted service availability
• Perfect accuracy in clip detection or transcription for all video types
• Specific processing times (analysis typically completes within minutes)
• Compatibility with all video formats or publishing platforms

We reserve the right to modify, suspend, or discontinue the service with reasonable notice.

8. Prohibited Uses

You may not use shortshero to:

• Process or distribute videos that violate any laws or regulations
• Create misleading, defamatory, or harmful content
• Generate deepfakes or impersonate others without consent
• Produce explicit, offensive, or inappropriate content
• Attempt to overload or abuse our processing infrastructure
• Share your account credentials with others
• Use the service to directly compete with or replicate shortshero
• Infringe on others' intellectual property rights

9. Limitation of Liability

To the maximum extent permitted by law, shortshero shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — resulting from your use of or inability to use the service; any errors in clip detection or transcription; any unauthorized access to our servers; or any interruption in service.

Our total liability to you for all claims relating to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Refund Policy

Due to the nature of our AI processing service:

• All credit pack purchases are final and non-refundable
• Credits do not expire and remain available for future use
• In cases of verified technical failures (e.g., credits deducted but no clips produced due to a platform error), we may provide credit compensation at our discretion
• Contact support if you experience significant service issues

11. Account Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to shortshero will be suspended
• You retain ownership of all clips you have already downloaded
• We may delete your account data after 90 days (or immediately upon request)
• No refunds will be provided for unused credits
• Export and download any clips you wish to keep before closing your account

We reserve the right to terminate accounts that violate these terms or engage in prohibited activities without prior notice.

12. Third-Party Social Media Integration (Zernio)

shortshero integrates with Zernio, a third-party social media scheduling and publishing API, to enable connections with platforms including YouTube, TikTok, Instagram, Facebook, LinkedIn, and Pinterest.

• Bring Your Own Key (BYOK): To use social publishing features, you must provide your own Zernio API key obtained from zernio.com.
• Zero-Knowledge Key Handling:shortshero does NOT store, log, transmit, or retain your Zernio API key on our servers. The key is stored exclusively in your browser's localStorage and used client-side only.
• Zernio Pricing:Zernio's free tier supports up to 2 connected social accounts. Additional accounts may incur charges directly on your Zernio account. shortshero has no control over and does not collect any Zernio fees.
• Zernio's Terms Apply:Your use of Zernio is governed by Zernio's own Terms of Service and Privacy Policy. shortshero is not responsible for Zernio's availability or changes to their service.

13. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. We will notify users of any material changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.
